Sergei Bakeshin - Counsel

On 29 May, Head of the Insolvency Practice at Maxima Legal, Sergey Bakeshin took part in a joint seminar with GSL titled “Risks for the owners of foreign companies. Corporate veil or amnesty of capital – which to choose?”.

Sergey gave a presentation on the topic of subsidiary liability of controlling individuals and explored one of the variants of how ‘lifting the corporate veil’ might be achieved.

At the end of December 2017, a decision of the Supreme Court analysed the changes made to insolvency law in the summer of last year. In particular the changes clarified the understanding of ‘controlling debtor’ and toughened the penalties for being found subsidiary liable for the liabilities of a company.
